On Friday, April 26, 2019, Elekta Ltd. and its US operating company Elekta, Inc. (“Elekta”) filed a lawsuit against ZAP® Surgical Systems in the United States District Court for the Northern District of California. The lawsuit asserts that the ZAP-X® Gyroscopic Radiosurgery™ platform infringes Elekta’s US Patent No. 7,295,648. The lawsuit requests the typical remedies for patent infringement, including damages and an injunction.
ZAP Surgical is acting quickly and will aggressively defend itself. In conjunction with legal counsel, ZAP Surgical has identified multiple non-infringement and invalidity positions that are now being further developed.
